REGISTRATION OF PATENTS
A patent is a legal right granted by the government to the original inventor or the first claimed inventor, allowing them to make, use, sell, license, import, and produce their invention. This exclusive right prevents others from using or reproducing the invention without explicit permission. Patent rights are jurisdiction-specific, as each country has its own intellectual property laws governing patents.

According to The Patent Act (India), 1970, only inventions can be patented [Section 2(1)(m)]. Section 2(1)(j) defines an “invention” as a new product or process involving an inventive step and capable of industrial application.

Patent Registration Procedure in India:
Section 3 of The Patent Act outlines items that are not considered inventions and, therefore, are non-patentable:
- Frivolous inventions or those violating natural laws.
- Inventions against public order, morality, or harmful to human, animal, plant life, or the environment.
- Mere discovery of an abstract theory or naturally existing substance.
- Discovery of a new form, property, or use of a known substance unless it results in a new product or efficiency improvement.
- Substances obtained by simple admixture, resulting in mere aggregation of component properties.
- Mere arrangement, re-arrangement, or duplication of known devices working independently.
- Agricultural or horticultural techniques.
- Medical, surgical, curative, or diagnostic methods for treating humans or animals.
- Plants and animals (except microorganisms) and their biological processes.
- Mathematical methods.
- Standalone computer programs or algorithms.
- Business methods.
- Literary, artistic, musical, and cinematographic works (covered under copyright laws).
- Methods of performing mental acts or playing games.
- Data presentation formats (e.g., databases).
- Integrated circuit layouts.
- Traditional knowledge or duplications of known traditional properties.
Patent Renewal:
A granted patent must be renewed annually by paying a renewal fee. In India, a patent can be renewed for up to 20 years from the filing date.
